Welcome to Paku3D. By using our website and 3D printing services, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully.

1. Acceptance of Terms
By accessing or using our website and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Service Description
Paku3D provides the following services:
- 3D printing of user-uploaded STL files
- Selection of filament types (PLA, ABS, PETG, TPU) and colors
- Shipping of 3D printed items to customer-provided addresses

3. User Responsibilities
When using our services, you are responsible for:
- Ownership of Models: Ensuring you have the right to use and print any 3D models you upload.
- Model Suitability: Ensuring your models are properly designed for 3D printing and meet our size limitations (256mm × 256mm × 256mm).
- Prohibited Content: Not uploading models that infringe on intellectual property rights, are illegal, harmful, or offensive.
- Accurate Information: Providing accurate personal information for order processing and shipping.

4. Prohibited Items
For safety and legal reasons, we do not accept orders for the following items:
- Medical Devices: Any items intended for medical use, including prosthetics, surgical tools, dental appliances, or diagnostic equipment.
- Safety-Critical Parts: Components for vehicles, aircraft, climbing equipment, lifting equipment, or any application where failure could result in injury or death.
- Weapons and Weapon Components: Firearms, firearm parts or accessories, knives designed as weapons, or any item intended to cause harm.
- Items for Young Children: Toys or items intended for children under 3 years old due to choking hazard concerns.
- Pressure Vessels: Items designed to contain pressurized liquids or gases.
- Food Contact Items: Items intended for direct contact with food or beverages (3D printed items may contain unsafe materials or harbor bacteria).
- Trademarked or Copyrighted Content: Items that infringe on intellectual property rights, including but not limited to copyrighted characters, logos, or trademarked designs without proper authorization.
- Illegal Items: Any item that is illegal to produce, possess, or distribute under federal, state, or local law.

Note on Cosplay and Fan Art: We understand that cosplay is a creative hobby that often involves recreating elements from copyrighted works. While we provide 3D printing services for cosplay props and accessories, you as the customer are responsible for ensuring your use complies with applicable intellectual property laws. Items printed for personal, non-commercial cosplay use may fall under fair use or be permissible fan creations, but we cannot provide legal advice. We do not accept orders for items intended for commercial resale of copyrighted or trademarked content.

We reserve the right to refuse any order that we determine falls into these categories or poses safety, legal, or ethical concerns. Orders for prohibited items will be cancelled and refunded.

5. Order Process and Payment
- File Upload: You may upload STL files up to 50MB in size.
- Pricing: The cost of printing is calculated based on the model complexity, filament type, and shipping option.
- Payment: All payments are processed securely through our payment processor.
- Rate Limiting: To ensure system stability, we limit users to 10 file uploads per 24-hour period.

6. Shipping and Delivery
- Processing Time: We aim to process and print all orders within 3-5 business days.
- Shipping Options: We offer Standard and Express shipping options.
- Shipping Delays: We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

7. Refunds and Returns
- If your print arrives damaged or with significant quality issues attributable to our printing process, please contact us within 7 days of receipt.
- We do not offer refunds for prints that meet our quality standards but do not match your expectations due to design issues.
- Refunds are processed back to the original payment method.

8. Intellectual Property
- Your Content: You retain all intellectual property rights to the 3D models you upload.
- Limited License: By uploading 3D models, you grant us a limited license to reproduce your model solely for the purpose of fulfilling your order.
- Our Content: All website content, excluding your uploaded models, is the property of Paku3D and protected by copyright and other intellectual property laws.

9. Limitation of Liability
- Our total liability for any claims related to your use of our services is limited to the amount you paid for the specific order in question.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- We are not liable for any issues arising from incorrectly designed 3D models.
- We are not liable for any injuries, damages, or losses resulting from the use of 3D printed items, including but not limited to structural failures, material defects, or improper use.

10. Dispute Resolution
- Any disputes arising from these terms will first be attempted to be resolved through informal negotiation.
- Any legal proceedings shall be brought in the courts of Illinois, and you consent to the jurisdiction of such courts.

11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following the posting of revised terms constitutes your acceptance of the changes.

12. Termination
We reserve the right to terminate or suspend your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users or us.
